Terms and Conditions for Stone and Ore SalesThese Terms and Conditions (“Agreement”) govern the purchase of natural stone, mineral ores, and raw geological materials from [www.orerealm.com](“Seller”). By placing an order, the Buyer agrees to be bound by these terms, which constitute a legally binding contract.[1] [2]1. Nature of Materials and VariationsThe Buyer acknowledges that stone and ore are products of nature. As such, they are subject to natural variations in color, shade, texture, density, and geological composition.[3] [4] Samples provided are intended only to offer a general representation of the material’s character and do not constitute a guarantee that the bulk delivery will match the sample exactly in every characteristic.[5] [6].2. Inspection and AcceptanceThe Buyer is responsible for inspecting all materials immediately upon delivery or pick-up.[9] For bulk ore shipments, the Buyer must verify the weight and apparent quality before the transport vehicle leaves the site.[10] Any claims for visible defects, shortages, or non-conformity must be noted on the Bill of Lading at the time of delivery.[11] Failure to notify the Seller of such discrepancies within forty-eight (48) hours constitutes an irrevocable acceptance of the goods.[12] [13]3. Pricing and PaymentAll prices are subject to change based on market fluctuations in mineral commodities unless a fixed-price contract is signed.[14] 4. Refund and Return PolicyDue to the high costs of logistics and the heavy nature of stone and ore, the following refund policy applies:Final Sales: All sales of custom-cut stone, crushed ore, or special-order minerals are final.[18] [19]Authorized Returns: Returns on standard stocked items may be accepted at the Seller’s sole discretion within seven (7) days of receipt.[20]Restocking Fee: All authorized returns are subject to a 30% restocking fee to cover handling and storage.[21] [22]Condition: Materials must be returned in their original packaging (crates/sacks) and in the same condition as delivered. Contaminated, damaged or mixed ore cannot be returned.[23]Shipping Costs: The Buyer is responsible for all return freight charges. Original shipping fees are non-refundable.[24]5. Limitation of LiabilityThe Seller’s liability for any claim arising out of the sale of materials shall not exceed the purchase price paid by the Buyer for the specific portion of the material giving rise to the claim.[25] [26] The Seller is not liable for any consequential, incidental, or labor-related damages, including costs associated with the installation or removal of defective stone.[27] [28]6. Governing LawThis Agreement shall be governed by the laws of the jurisdiction in which the Seller’s primary warehouse is located.[29]
